{"id":29214,"date":"2025-02-11T00:49:05","date_gmt":"2025-02-11T00:49:05","guid":{"rendered":"https:\/\/freshsites.download\/celenews\/don-henley-sued-by-rare-books-dealer-in-eagles-stolen-lyrics-dispute\/"},"modified":"2025-02-11T00:49:05","modified_gmt":"2025-02-11T00:49:05","slug":"don-henley-sued-by-rare-books-dealer-in-eagles-stolen-lyrics-dispute","status":"publish","type":"post","link":"https:\/\/freshsites.download\/celenews\/don-henley-sued-by-rare-books-dealer-in-eagles-stolen-lyrics-dispute\/","title":{"rendered":"Don Henley Sued by Rare-Books Dealer in Eagles Stolen Lyrics Dispute"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tA rare-books dealer <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/eagles-hotel-california-lyrics-charged-rock-and-roll-hall-of-fame-1381952\/\">previously<\/a> <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/eagles-hotel-california-stolen-lyrics-trial-what-we-know-1234969122\/\">accused of trying to sell<\/a> stolen copies of handwritten <a href=\"https:\/\/www.rollingstone.com\/t\/eagles-2\/\" id=\"auto-tag_eagles-2\" data-tag=\"eagles-2\">Eagles<\/a> lyrics has filed a lawsuit of his own against <a href=\"https:\/\/www.rollingstone.com\/t\/don-henley\/\" id=\"auto-tag_don-henley\" data-tag=\"don-henley\">Don Henley<\/a> and manager Irving Azoff.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tGlenn Horowitz was one of three defendants who faced criminal charges last year for conspiring to possess stolen property \u2014 in this case, over 100 pages of drafts of songs from the Eagles\u2019 <em><a href=\"https:\/\/www.rollingstone.com\/feature\/the-eagles-hotel-california-10-things-you-didnt-know-111526\/\">Hotel California<\/a><\/em>, written by Henley and Glenn Frey. When some of those pages were considered for auction during the 2010s, Henley claimed they were stolen, taking the case to the Manhattan District Attorney\u2019s Office, which finally indicted Horowitz and the other two defendants in summer 2022.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tLast year, the case finally went to trial, but three weeks into it, the <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/eagles-hotel-california-don-henley-court-dismissed-1234982074\/\">prosecutors dropped the charges<\/a>, saying new information had come to light and stating their \u201cconfidence in the merits of this case is not enough.\u201d Henley has <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/don-henley-lawsuit-hotel-california-lyric-sheets-1235049680\/\">since filed a civil suit of his own<\/a> to retain possession of the lyrics (which remain in the custody of the DA\u2019s office). And now Horowitz is suing Henley, claiming he knew all along that the lyrics were not stolen and intentionally hid this knowledge from the authorities.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tHorowitz\u2019s lawsuit specifically accuses Henley, Azoff, and their legal representatives of malicious prosecution, intentional infliction of emotional distress, and more. He is seeking punitive damages to be determined at trial.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tA lawyer for Horowitz, Caitlin Robin, previously told <em><a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/hotel-california-eagles-lawsuit-henley-b2694406.html\">The Independent<\/a><\/em>, \u201cGlenn is looking forward to his day in court. He already cleared his name when the charges against him were dismissed but it\u2019s time to hold those responsible who were involved in his malicious prosecution.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tDan Petrocelli, a lawyer for Henley and Azoff, told <em>Rolling Stone<\/em>, \u201cDon Henley was a witness and a victim in a criminal trial brought by the Manhattan District Attorney after a formal indictment of Glenn Horowitz by a New York grand jury. The indictment highlighted the dark underbelly of the memorabilia business that exploited the brazen, unauthorized taking and selling of Mr. Henley\u2019s handwritten lyrics. Sanders was given an array of research material for the book, including the notepads with the lyrics. While the book was scrapped just one year later, Sanders reportedly held onto the research material for more than two decades.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tAccording to Horowitz\u2019s new suit, in 2005, he and business partner John McWhinnie purchased the handwritten lyrics from\u00a0Sanders. Over the next several years, the lyrics were bought and sold a few times, with Horowitz and McWhinnie always involved; eventually, in 2012, the lyrics ended up in the hands of former Rock &amp; Roll Hall of Fame curator Craig Inciardi and rock memorabilia dealer Edward Kosinski. At this point, Horowitz claims, his affiliation with the lyrics was \u201cterminated\u201d and \u201cnever to be reassumed.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIt was after Inciardi and Kosinski tried to put excerpts from the lyrics up for auction that Henley became involved. According to Horowitz\u2019s suit, Henley\u2019s lawyer reached out to Kosinski about selling some of the notepads back to Henley. A sales agreement for one notepad was drawn up and executed in April 2012 for $8,500. In court, Henley testified that he resented \u201cbuying my own property back\u201d but told the court that it was \u201cthe most practical and expedient way\u201d to remove the auction listing. After the musician, with the help of Azoff, tried to block a sale of the \u201cHotel California\u201d draft lyrics in 2016, the Manhattan DA\u2019s office got involved. (Kosinski and Inciardi were the two other co-defendants in the eventually-abandoned criminal case.)<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tHorowitz claims that Henley \u201cknew or should have known\u201d that Horowitz \u201clawfully owned and possessed the handwritten lyrics as of 2005 and lawfully exercised his right of sale thereof in 2012.\u201d Nevertheless, the suit continues, Henley \u201cpursued and materially assisted tin the commencement and continuation of criminal proceedings against [Horowitz] by making false statement to law authorities\u2026 with malicious intent to wrongfully imrpison him and cause adverse publicity to his business.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tHenley, for his part, has always maintained that the notepads were his property.
